PRO SPEX REFERRAL PROGRAM TERMS AND CONDITIONS:

 

 

1.      One customer cannot be referred by 2 or more persons. The person identified as the referee by the potential customer, either by Name or Pro Spex Inspection number, will be awarded the referral fee.

2.      In order to receive a referral fee, the customer must use our services to provide a full PRE-purchase or PRE-sale inspection.

3.      The customer referred must fulfill all terms of their contract for the referee to qualify.

4.      The customer must provide the referee their Pro Spex report number and name.

5.      Payment must be made in full, on or before the completed inspection.

6.      Scheduling the inspection can be done by either customer.

7.      Offer does not apply to persons directly involved in the real estate transaction (agents, brokers, or lenders etc.)

 

Pro Spex reserves the right to terminate this program at any time for any reason.

 

By participating in the Pro Spex Referral Program, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

 

  1. Eligibility. This Bonus is open to all existing customers of PRO SPEX and on the following terms and conditions. An existing customer being defined as one who has paid for any combination of PRO SPEX inspection services.

 

  1. Persons Who May Be Referred. You must only refer PRO SPEX to individuals with whom you have a pre-existing personal or business relationship and whom you believe would like to use PRO SPEX services in the purchase, sale or maintenance of residential property. Without limiting the generality of the foregoing, you must not obtain names for referral from I) group email addresses or ii) email mailing lists. You must not submit yourself for this referral bonus.

 

  1. No Spamming. We strictly forbid the sending of unsolicited e-mails to numerous recipients ("spamming") and any PRO SPEX customer who spams other Internet users for referral bonuses will have his or her account immediately and permanently terminated. See our Anti-Spam Policy for additional information.

 

  1. Number of Referral Bonuses. For a limited time, there are no restrictions on the number of referral bonuses you may earn. 2 or more persons cannot receive referral bonuses for the same person referred. Where 2 or more persons refer the same individual, the person being referred shall determine who receives the referral bonus.

 

  1. Refer-A-Friend Reward Credited to Your Account. For each of your Friends that you refer to PRO SPEX who completes a full home inspection, we will pay $15.00 U.S. PRO SPEX BUCKS (or such other amount that we determine in our sole discretion from time to time, as published in this Terms and Conditions) to you. A Friend will only be deemed to have been referred for the purposes of these Terms and Conditions if:
    1. They are not a PRO SPEX customer at the time they are referred.
    2. They satisfy the bonus requirements in effect at the time they complete the Bonus qualification process.
    3. Schedule a PRO SPEX full service home inspection.
    4. Complete PRO SPEX full service home inspection.

 

  1. Remedies for Your Non-compliance. If PRO SPEX determines in its sole discretion that you have not complied with these Terms and Conditions, it may, in addition to any other rights and remedies it may have against you, immediately and without notice to you, withdraw all benefits to you and your Friends under this Bonus (including, without limitation, non payment of the referral bonus).

 

  1. Your Consent to Use Your Data in E-Mails. You grant to the PRO SPEX service your consent for it to use your name and email address for the purposes of sending email to your Friends for Bonus processing. You agree not to use any false email addresses or names for this Bonus.

 

  1. Your Privacy. Your contact information is strictly private and will only be used for the purpose specified herein and shall not be disclosed to any party not affiliated with this program.

 

  1. Your Representations and Warranties to Us. You represent and warrant to PRO SPEX that you have an existing business or personal relationship with each Friend and that it is your genuine opinion that each Friend would wish to use PRO SPEX inspection services.

 

  1. Bonus Period. PRO SPEX reserves the right to discontinue the Bonus for any reason, at any time and for any duration at its sole discretion, and without notice.

 

11.  Payment schedule. Payment will be made within 30days of the completed inspection by check, money order, or gift certificate. An inspection is defined as completed, when the inspection has been performed and the customer as fully satisfied all terms of the inspection contract, including payment.

 

  1. Limitation of Liability for PRO SPEX. TO THE FULLEST EXTENT PERMITTED AT LAW, NEITHER PRO SPEX NOR ANY OF ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, OR OTHER REPRESENTATIVES WILL BE LIABLE FOR DAMAGES ARISING OUT OF OR IN CONNECTION WITH THIS OFFER. THIS IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING (WITHOUT LIMITATION) COMPENSATORY, DIRECT, INDIRECT, OR CONSEQUENTIAL DAMAGES; LOSS OF DATA, INCOME, OR PROFIT; LOSS OF OR DAMAGE TO PROPERTY; AND CLAIMS OF THIRD PARTIES.

 

  1. Entire Agreement. These Terms and Conditions represent the entire agreement between you and PRO SPEX with respect to the Bonus.

 

  1. Variation of the Terms and Conditions. These Terms and Conditions may be amended or modified by PRO SPEX in its sole discretion at any time and these amendments and modifications will apply to you when you use the PRO SPEX service. Any such amendments will be posted to this page, and it is your responsibility to review this page from time to time for such amendments.

 

  1. Currency. All amounts stated in these Terms and Conditions are in US currency.

 

  1. Severance. If any provision of these Terms and Conditions is held to be invalid, such invalidity will not affect the remaining provisions.

 

  1. Governing Law. These Terms and Conditions will be interpreted, construed, and governed in all respects in accordance with the laws of the State of Maryland, without giving effect to its principles of conflicts of laws. You hereby irrevocably consent and submit to the exclusive personal jurisdiction of The State of Maryland, for the purposes of litigating any such action.
